The Anti-Dumping Review Panel (ADRP) has received applications for review of the decision of the Assistant Minister for Industry, Innovation and Science, made on 13 September 2016, to secure the continuation of anti-dumping measures on consumer pineapples exported from the Republic of the Philippines (Philippines) and the Kingdom of Thailand (Thailand), and to secure the continuation of measures on Food Service and Industrial (FSI) pineapple from Thailand ('Reviewable Decisions'). Notice of the Reviewable Decisions was published on 13 September 2016 on the Anti-Dumping Commission's website.
The applications were received from:
'Kuiburi Fruit Canning Co., Ltd- dated7 October 2016;
'Prime Products Industrial Co., Ltd- dated 12 October 2016; and
'Dole Philippines Incorporated- dated 13 October 2016;
Under subsection 269ZZK(1) of the Customs Act 1901, the Panel is required to make a report to the Parliamentary Secretary on the applicationrecommending that the Parliamentary Secretary either affirm the Reviewable Decision or revoke the Reviewable Decision and substitute a specified new decision.
On 9 January 2017, the Panel requested a reinvestigation in relation to Food Service and Industrial (FSI) Pineapple exported to Australia by Kuiburi Fruit Canning Co. Ltd. Consequently, the Panel has divided this review into two parts:
1.Consumer Pineapple exported from the Republic of the Philippines and the Kingdom of Thailand (ADRP Report No. 48); and
2.Food Service and Industrial Pineapple exported from the Kingdom of Thailand (ADRP Report No. 50).
