Merchant Bar exported from Taiwan

The Anti-Dumping Review Panel (Review Panel) received an application from InfraBuild NSW Pty Ltd (InfraBuild) seeking a review of a decision by the Commissioner of the Anti-Dumping Commission (ADC) to terminate Investigation 584 in accordance with section 269TDA(13) of the Customs Act 1901 (the Act) in respect of Merchant Bar exported to Australia from Taiwan (the Reviewable Decision). Notice of the Reviewable Decision was published on the Anti-Dumping Commission's website (EPR 584) on 6 September 2022 (ADN 2022/091 refers).

Under subsection 269ZZT(1) of the Act, the Review Panel must make a decision on the application by affirming the Reviewable Decision or revoking the Reviewable Decision. 

The Panel's decision was subject to judicial review proceedings in the Federal Court of Australia. A link to the matter on the Commonwealth Courts portal is available here.
