Flat, electric cables, comprising two copper conductor cores and an earth (copper) core with a nominal conductor cross sectional area of between, and including, 2.5 mm2and 3 mm2, insulated and sheathed with polyvinyl chloride (PVC) materials, and suitable for connection to mains electricity power installations at voltages exceeding 80 volts (V) but not exceeding 1,000 V, and complying with Australian/New Zealand Standard (AS/NZS) AS/NZS 5000.2 (the Australian Standard), and whether or not fitted with connectors.

On 13 February 2020, Justice Kerr of the Federal Court of Australia made orders by consent setting aside the decision of the then Minister for Industry, Science and Technology (the Minister) to make declarations under subsections 269TG(1) and (2) of the Customs Act 1901, in so far as the decision applied in respect of certain polyvinyl chloride flat electrical cables (PVC cables) exported to Australia by Guilin International Wire & Cable Co Ltd (Guilin) from the People’s Republic of China (China). The matter was remitted back to the Minister and is currently under reconsideration.
The orders did not set aside Report 469 of the former Commissioner of the Anti-Dumping Commission so the Commissioner’s role in advising the Minister in relation to this matter has been fulfilled. As a result, the Department of Industry, Science, Energy and Resources (the department) is assisting the Minister reconsider the matter and make a final decision with respect to exports by Guilin.
The department sought submissions from interested parties in late 2020 to inform the Minister’s reconsideration, and intends to seek further submissions ahead of recommending the Minister make a final decision.
